Aadhaar Deadline Could be Extended Beyond March 31 Centre Tells Supreme Court

The Attorney General KK Venugopal informed the court that the government had not given any instruction to the CBSE to insist on Aadhaar as the students can produce any other form of identity.

In an interim order, the Supreme Court stayed the CBSE's notification, and said aspirants could use any other documents, such as voter IDs, driving licences or passports, to apply for exams, Bar and Bench reported.

Attorney General of India, K K Venugopal told a Bench headed by Chief Justice of India, Dipak Misra that the centre has done it in the past and it could do it again if required.

The court order came on a plea by a Gujarat resident who has challenged the CBSE circular mandating Aadhaar-only identity for those appearing in National Eligibility cum Entrance Test (NEET) for undergraduate medical courses - MBBS and Bachelor of Dental Surgery. "Thousands of students are suffering, uncertain about their future. the Supreme Court has to send a clear message. something has to be done", Mr. Datar urged the five-judge Bench.

Interestingly, the Supreme Court had rejected a petition seeking an extension of deadline beyond March 31, 2018 for linking Aadhaar with a host of services like banking, mobile phones and schemes like post office deposits last month.

However, the CBSE had made the Aadhaar number or Aadhaar enrolment number mandatory for students aspiring to take the NEET 2018.

In 2017 December 15, the summit court had stretched out until March 31 the due date for compulsory link of Aadhaar with different services and welfare plans.

The attorney-general gave the assurance during the closing hours of the day's hearing in response to pleas made by senior advocates who felt the hearing might extend beyond March 31.

On extending the linkage of Aadhaar for various services beyond March 31, the AG said though the government was willing to extend, it would argue on this point.

"We had extended the ambit of our orders [on the voluntary nature of Aadhaar] to even the State governments", Justice D.Y. Chandrachud on the Constitution Bench reacted.
